Javascript tick box wont detect its ticked

I have created a page here with a form:

The validation does not seem to be working correctly. It should only pop up when you try to hit submit if they have not ticked the box, but even if they tick the box to agree it still pops up, try and you will see.

Need someone to fix it please, ASAP.
