I have submitted a petition under NC GS 55A-14-30(a)(3)(a): 55A‑14‑30. Grounds for judicial dissolution. (a) The superior court may dissolve a corporation: (3) In a proceeding by a creditor if it is established that: a. The creditor's claim has been reduced to judgment and execution on the judgment has been returned unsatisfied. I've been using AI to help me with the petition and research, but do not have access to case law and precedent, and I can't find any precedent of someone filing a petition under this part of the statute. (It just isn't done very often.) I need help researching this, to find caselaw that has used this provision, to help me establish standing. And, more generally, just any other instances of a creditor initiating a petition. I am a creditor of the nonprofit, and my claim has been reduced to judgment (14 years ago) and returned unsatisfied (6 years ago). But it is no longer enforceable. Based on the plain language of the text, enforceability shouldn't matter. But it will definitely come up, and I need ammunition. Note: I am NOT looking to collect, and collection is not the purpose of NC GS 55A-14-30. I am seeking injunctive relief, to rehabilitate (not dissolve) the nonprofit and have a receiver assigned to take over and manage the nonprofit, due to many, many instances of poor governance. Also, note: NC GS 55-14-30 has similar language for a business corporation, and so that could be useful, too. The Model Nonprofit Corporation Act also has similar language, but is narrower than the NC statute, and only applies to nonprofits that are insolvent. NC altered the text to make this statute more broad. If this goes well, there are plenty of other areas related to this case that I would like someone to help me research and frame. I've attached the petition as submitted, though I have done more work on it since. Trial is scheduled for May 26.
