The case was dismissed at the Motion to Dismiss (MTD) stage, and the entire record is under 300 pages. The substantive text of the brief will be provided by me. Your role is to build a perfectly formatted "Shell Brief," generate the necessary tables, and properly compile/index the single-volume ER to ensure seamless compliance with the Clerk's office. Key Responsibilities & Deliverables 1. Appellant’s Opening Brief Shell & Formatting: o Set up a Word document template complying strictly with FRAP 32 and Ninth Circuit Rule 32-1 (14-point proportional font, correct margins, line spacing, and cover page layout). o Insert mandatory structural placeholders: Jurisdictional Statement, Statement of the Issues, Standard of Review, and the Statutory Addendum (9th Cir. R. 28-2.8). o Generate a dynamic Table of Contents and Table of Authorities (Bluebook compliant) once the text is finalized. o Prepare Form 8 (Certificate of Compliance) and the Certificate of Service. 2. Excerpts of Record (ER) Assembly (Ninth Circuit Rule 30-1.6): o Compile a Single-Volume Excerpts of Record (ER) under 300 pages with a white cover page. o Organize the record documents in reverse chronological order as required by the Circuit, ensuring the District Court Docket Sheet is placed immediately after the Index. o Include the operative complaint, the MTD briefing, the opposition brief (highlighting the "Relief Sought" section where leave to amend was requested), and the denied/lodged proposed amended complaint. o Electronically paginate the file consecutively (ER-1, ER-2, etc.), create a comprehensive Index, and deliver a fully text-searchable, bookmarked PDF file ready for e-filing. Required Qualifications • Proven experience formatting and filing briefs/ERs directly with the U.S. Court of Appeals for the Ninth Circuit. • Absolute mastery of Ninth Circuit Rule 30-1.6 (Single-Volume ER rules) and Form 8 compliance. • High proficiency in Microsoft Word (Styles, Section Breaks, Table of Authorities generation) and Adobe Acrobat Pro (Bates stamping, bookmarking, optimizing PDFs). • Strict attention to detail regarding local rules, font sizes, margins, and page/word limits.
