I am trying to sell my house to my wife (I own my own business and do not qualify for a refinance and as she was not on title, we can't get a cash out refinance). FHA required to pull my credit as well and a negative item was reported for a personal guarantee I had signed.
I do not need to get the item removed, I need to obtain a letter that explains the statute of frauds in Arizona to FHA. They have requested I provide them a copy of the loan agreement, proof it was in deed a personal guarantee and an letter from an attorney explaining that under the Arizona Statute of Frauds my wife cannot be held liable for a debt of another without agreeing to it. The law is ARS A.R.S. § 44-101(2)
