I am looking for assistance in my Virginia family law case in regards to how I obtained evidence to prove that the non custodial parent violated the judge's court order. My daughter (12yrs old) has a cell phone that was purchased and paid for by the non custodial parent. To ensure her safety I review what is on her phone daily (calls, apps, etc). I found the photos with the data showing they were taken of my daughter in DC but looking for case law to show that how I obtained evidence can be permissible as my daughter is a minor. Looking for any evidentiary case law to show a parent can legally go into childs phone and use evidence in court. Preferably without having to have our child testify. I already have an attorney but want to help strengthen my case as we are trying to ensure we can fight any evidentiary argument from opposing counsel.
