Dear Sir/Madam,
Do you have a business in China? Pursuant to Article 19 of the Patent Law : Foreigners, foreign enterprises, or other foreign organizations that do not have a habitual residence or place of business in China shall entrust a patent agency established in accordance with Chinese law to apply for patents and handle other patent affairs in China. Therefore, if you are located in Canada, you will have to entrust an agent to file the application. I can refer you some reliable agencies for your consideration.
I have applied a design patent for a Canadian friend before, but he has a company in China so I can just use his company’s name to submit the application. Only CAD250 government fees incurred. For design patent, to appoint a registered agent to submit the application usually cost CAD440. For your situation, I think we will need to discuss in detail.
According to the Chinese Patent Law, three types of patents are issued in China, namely invention patents, utility model patents, and design patents. Which one would you like proceed with?
Nevertheless, I can assist you in the matter for CAD 500, excluding the government fees and agent fees if necessary. The work will include: communicating with you, doing research, draft application to CNIPA and translation. I estimate an agent will cost an extra CAD 1930 if you want to apply for an Invention Patent, or an extra CAD 440 if you just want to apply for a design patent.
Sincerely,
Mia
