I am midway through a 1(b)-to-1(a) US trademark application and now must complete the foreign-filing documentation and tackle an Office Action that questions similarity to an existing mark. Current status • Canadian filing is already on record, so I need the appropriate priority evidence and any required translations or declarations sent to the USPTO to lock in that date. • The Office Action’s sole issue is “Similarity to existing trademarks.” I have not started a draft response; I’m looking for targeted assistance rather than a full soup-to-nuts rewrite. What I need from you 1. Prepare and submit the foreign filing basis paperwork, ensuring all USPTO formalities are met. 2. Craft a persuasive, citation-backed argument addressing the likelihood-of-confusion concern—case law, DuPont factors, co-existence agreements if you recommend one—so I can file a timely, polished response. Acceptance criteria • USPTO receives a complete, correctly formatted foreign priority claim referencing my Canadian application. • A response brief (Word + PDF) that directly rebuts the similarity objection, ready for my final sign-off and TEAS upload. If you see strategic value in later expanding protection to the EU or China, I’m open to a short memo on that, but the priority right now is resolving the U.S. issue.

I am a U.S. licensed patent and trademark attorney based in San Diego, California, with over 25 years of experience helping clients protect their brands and inventions. A US licensed attorney is required for all foreign based applicants. My fixed fee for preparing a typical U.S. trademark application for registration of a word or a logo mark in one class is $250. I include a knockout search of the U.S. federal trademark database and all the U.S. State trademark databases. The search results include similar matches in the USPTO trademark database and all US State trademark databases with some additional checks of common law databased (unregistered potential conflicting uses.) The filing fee is normally $350-550 per class of goods or services and this fee is paid directly to the USPTO upon filing and is not included in my bid. After filing, as a U.S. licensed attorney, I communicate with the USPTO Examiner on your behalf should any issues come up with your application. Any additional work after the filing of the application (including reviewing and responding to office actions and communications) is billed separately based on time. You can also apply to the Amazon Brand Registry about one or two days after your filing date. Once Amazon processes your request, they will send me a verification code which I will forward to you so you can enroll in the registry program. Please let me know if you would like to discuss your project. Michael

Hello, I would be glad to assist with both aspects of your trademark matter: the foreign filing basis documentation and the Office Action response concerning likelihood of confusion. My experience includes legal research, trademark-related drafting, regulatory analysis, and preparation of structured legal submissions. I have worked extensively with case-law research, statutory interpretation, and persuasive legal drafting, enabling me to prepare well-supported responses tailored to the USPTO's requirements. For this project, I would: • Review the Canadian application and supporting documents to ensure the foreign priority claim is properly documented and referenced. • Verify compliance with applicable USPTO formalities under Sections 1(a), 1(b), and 44(d)/(e), as relevant. • Conduct targeted trademark research concerning the cited marks. • Analyze the DuPont factors and relevant USPTO precedents. • Prepare a citation-backed response brief addressing the likelihood-of-confusion refusal. • Provide practical recommendations regarding coexistence agreements or alternative strategies if beneficial. I can begin immediately upon receiving the application details, Office Action, and Canadian filing documents. I look forward to discussing the matter further. Thank you for your consideration.
